A regularly scheduled meeting of the Board of Trustees was held on Tuesday, February 19, 2013, in the Village Hall. Mayor Westcott opened the meeting at 7:00 p.m. Also present were Deputy Mayor Conley, Trustee Blumrick, Trustee Hinkson, Trustee McAvoy, Coordinator Dodge, Police Chief Swick, Clerk-Treasurer Schweigert, Building Inspector Brian Belson, and Daniel E. Seaman, attorney. Trustee McAvoy led the Pledge of Allegiance. There were representatives from the Middleport Fire Department and the Roy-Hart Youth Baseball Program in attendance, as well. A motion was made by Deputy Mayor Conley, and seconded by Trustee Hinkson, to approve the minutes of the January 3, January 22, and January 30, 2013, meetings. Motion carried unanimously. A motion was made by Trustee McAvoy, and seconded by Trustee Blumrick, to authorize payment of bills on Abstract No. 9-12/13 in the amount of General: $29,396.63; Water: $1,367.84; and Sewer: $9,729.13; for a Total of: $40,493.60. Motion carried unanimously. A motion was made by Trustee McAvoy, and seconded by trustee Hinkson, to approve payrolls 17, 18, and 19 for weeks ending January 19, February 2, and February 16, 2013. Motion carried unanimously. The Treasurer’s report was submitted and accepted for January 2013. The Public Works report was submitted and accepted for January 2013. Deputy Mayor Conley asked if overtime use was okay. Mr. Dodge will check on the figures. The Village and Town Police reports were submitted and accepted for January 2013. The fire report was submitted and accepted for January 2013. There was no Code Enforcement report for January as we did not have the position filled yet. The Water and Sewer billing for the quarter ending February 1, 2013: Water: $49,328.23 and Sewer: $49,046.38 for a total of $98,952.11. This figure is down about $15,000 from last year, due to Niagara Foods closing. The following resolution was offered by Trustee McAvoy, who moved its adoption, and seconded by Deputy Mayor Conley: RESOLVED, that the forthcoming General Village Election will be held on Tuesday, March 19, 2013, from 12:00 p.m. noon until 9:00 p.m. at the Village Hall, Middleport, New York. The following candidates were nominated for the office and term set forth before each name: ACTION PARTY Mayor: Two-year term Richard J. Westcott 13 Mechanic Street Middleport, New York MIDDLEPORT 1ST Trustee - Two-year term Wayne B. Blumrick 31 State Street Middleport, New York THE VILLAGE PARTY Trustee – Two-year term Rebecca A. Hinkson 23 Freeman Street Middleport, New York RESOLVED, that this resolution shall be published in the official newspaper of the Village of Middleport no later than February 28, 2013. The vote on the foregoing resolution was as follows: Ayes: Deputy Mayor Conley, Trustee Blumrick, Trustee Hinkson, Trustee McAvoy, and Mayor Westcott. Nays: None. Absent: None. The resolution was thereupon declared duly adopted. At this time the president and vice-president of the Royalton Hartland Youth Baseball/Softball League addressed the Board. President Jessica Heideman and Vice-President Brett Rhinehart presented current information, a newsletter, and financial breakdown for the league. Discussion ensued as to the direction of the league. Mayor Westcott asked if the league is in any way connected to the Little League organization out of Pennsylvania. President Heideman advised only when using equipment guidelines. Discussed necessary training for coaches, cost of equipment, cost of enrollment, financial help for families who can’t afford the enrollment fee, and cap of $120 per family. The League is asking for $2,500 in financial support again this year from the Village. Board will discuss and advise. At this time the Middleport Volunteer Fire Co., No. 1, Inc. representatives addressed the Board. Chief Nick Boyle and President Ross Hageman presented the Fire Company’s request for funding in the 2013-32014 budget. They would like an increase of $1,900, to a total of $88,100. Mayor Westcott asked for a concerted effort to get the quarterly audit submitted in a timely fashion, as it is not being done so now. The Village may withhold quarterly payments if the reports are not submitted. Discussed this issue. President Hageman will address it with the treasurer. At this time newly appointed Building Inspector Brian Belson addressed the Board. He has created a new fee schedule for building permits and explained the rationale behind most of them. Mr. Seaman advised he would like to review the schedule prior to the Board’s acting on it. Mr. Belson advised the Board of his working schedule. He will be in the office Saturdays from 9 am to 11 am and available Mondays through Wednesdays after 4 pm by appointment. He will also be visiting the Village Mondays through Wednesdays for inspections. Clerk Schweigert advised that this information is on the Village’s website. Trustee McAvoy asked that any fire inspection reports be sent to the Fire Chief. Mr. Belson agreed to this. Board discussed when a permit is needed as NYS has changed some of the regulations and permits are now required for some things that didn’t need a permit in the past. Correspondence was read: Received Canal Clean Sweep information Received request from General Code to allow them to sell our Village Code through their website. There will be no cost to the village to do this. Approved. General Code will be notified. Received the formula for sales tax distribution from Niagara County Information from NYCOM re: annual budget and legislation passed and not passed in 2012 by the New York State Legislature. Mayor Westcott received notification that Time Warner Cable will be increasing its rates Mayor Westcott received notification from Home Serve that they will be sending out letters to homeowners again regarding insurance on water lines. Although this is a legitimate service, the village does not endorse it. Received emergency phone numbers from NYSEG. Clerk Schweigert advised the board that Deputy Clerk-Treasurer Demmin as completed NIMS 100 and 700. Deputy Clerk Noble has completed NIMS 100 and is almost done with NIMS 700. The Clerk’s office will be in compliance for NIMS when Ms. Noble is done. Chief Swick is working on having his employees complete the training. In the DPW, Mr. Dodge has completed most of the necessary training, Steven Smith has completed the training, and Doug Eggert needs the training. Trustee Hinkson asked if the issue of having blinds installed at the Scout House has been resolved. Mayor Westcott met with the President of the Senior Citizens’ group. The blinds will be ordered and sent to the Village Hall. DPW personnel will install the blinds, regardless of the requests of certain members of the Seniors group. The Scout House is owned by the Village; therefore, the Village decides who does the work there. President Grant is happy with this conclusion. Mayor Westcott addressed Mr. Seaman’s email regarding the update on the brownfields in Middleport. Everything is moving along well regarding this issue. Chief Swick asked that the Board consider rescinding the waiver of probation granted to Sean Campus when he was rehired January 4, 2013. Orleans County Civil Service has indicated that Mr. Campus must go through the probationary period in order to be hired by any departments in Orleans County. If the board rescinds the waiver, he respectfully requests that the probationary period be retroactive to January 4, 2013 A motion was made by Trustee McAvoy, and seconded by Trustee Hinkson, to rescind the waiver of a probationary period for Sean Campus and to reinstate an 8-week period of probation retroactive to January 4, 2013. Motion was unanimously carried. Mr. Seaman advised that the deed to 31 Main Street will be coming through soon. Mayor Westcott advised the Board that it has come to his attention that the Village of Youngstown adds a $25 surcharge to all water shutoff notices. Clerk Schweigert said she’d been told by the Clerk of Youngstown that this surcharge has cut down considerably the number of notices that are sent out now. Mr. Seaman will take under consideration and advise the Board on whether or not they should also take this action. Mayor Westcott advised that the Village may add a fifth week onto the summer recreation program. Will be discussed during budget proceedings. Discussed budget meeting. A motion was made by Trustee Blumrick, and seconded by Trustee McAvoy, to set a budget meeting for Tuesday, March 5, 2013, at 6:00 p.m. in the Village Hall. Motion carried unanimously. Newspaper will be advised. Brett Rhinehart asked for the contact name for the annual Memorial Day Parade. Advised to contact Marty Ulrich from the Legion’s Ladies Auxiliary. Discussed current refuse contract. As it was extended through July 2014, we will need to discuss in the near future if it should be extended again at that time or rebid to see about lowering the cost. The next regular meeting of the Board of Trustees will be held on Monday, March 18, 2013, at 7:00 p.m. A motion was made by Trustee McAvoy, and seconded by Trustee Hinkson, to move into executive session for the purpose of discussions with the Village Attorney. Motion carried unanimously. Mayor Westcott opened executive session at 8:05 p.m. A motion was made by Deputy Mayor Conley, and seconded by Trustee Hinkson, to return to general session. Motion carried unanimously. Mayor Westcott reconvened general session at 8:42 p.m. A motion was made by Trustee McAvoy, and seconded by Trustee Blumrick, to authorize a contract with the Royalton-Hartland Youth Baseball/Softball League for 2013 at a cost of $2,500. Motion carried unanimously. A motion was made by Deputy Mayor Conley, and seconded by Trustee Blumrick, to authorize a contract with the Fire Department for April 2013 through March 2014 at a cost of $88,100. Motion carried unanimously. There being no further business, a motion was made by Deputy Mayor Conley, and seconded by Trustee Hinkson, to adjourn. Motion carried unanimously.
