A regularly scheduled meeting of the Board of Trustees was held on Monday, April 15, 2013, in the Village Hall. The annual reorganization meeting was also held at this time. Mayor Westcott opened the meeting at 7:00 p.m. Also present were Trustee Blumrick, Trustee Hinkson, Trustee McAvoy, Coordinator Dodge, Police Chief Swick, Clerk-Treasurer Schweigert, Code Enforcement Officer Belson, and Daniel E. Seaman, attorney. Deputy Mayor Conley was absent. Trustee Blumrick led the Pledge of Allegiance. There were several residents in attendance, as well. The first order of business was to swear in the newly elected officials: Mayor Westcott, Trustee Blumrick, and Trustee Hinkson. Mayor Westcott opened the public hearing regarding the 2013-2014 budget and the contract with the Fire Company. Clerk Schweigert read the notice. Mayor Westcott offered the following annual appointments: X Deputy Mayor: Trustee Conley X Sewer & Sanitation Department : Trustee Hinkson X Street Department: Trustee Blumrick X Water Department: Trustee McAvoy X Board Representatives to Youth Recreation: Trustees Conley & Blumrick X Zoning Board of Appeals: Richard A. Schweigert to a 3-year term X Youth Recreation: Executive Board : reappointed Jennifer Dinieri to a 3-year term X Planning Board: reappointed R. Francis Thomas to a 5-year term X Ethics Committee: reappointed Peggy Thomas, Elizabeth Storch, and Trustee Blumrick to a one-year term A motion was made by Trustee Blumrick, and seconded by Trustee McAvoy, to approve the above appointments. Carried with all present voting aye. A motion was made by Trustee Hinkson, and seconded by Trustee McAvoy to reappoint Clerk-Treasurer Rebecca A. Schweigert to a two-year term. Carried with all present voting aye. A motion was made by Trustee Blumrick, and seconded by Trustee Hinkson, to reappoint Historian Christa Lutz, Deputy Historian Barbara Albone, Deputy Village Clerk-Treasurer Vicky Demmin, and Deputy Clerk Barbara Noble to one-year terms. Carried with all present voting aye. A motion was made by Trustee McAvoy, and seconded by Trustee Blumrick, to designate Key Bank, Middleport Office, as the Bank Depository. Carried with all present voting aye. A motion was made by Trustee McAvoy, and seconded by Trustee Hinkson, to authorize the purchase of materials for street, water, and sewer departments at New York State or Niagara County bid prices. Carried with all present voting aye. A motion was made by Trustee Hinkson, and seconded by Trustee McAvoy to authorize Daniel E. Seaman to handle all legal matters on a per diem basis. Carried with all present voting aye. A motion was made by Trustee McAvoy, and seconded by Trustee Blumrick, to authorize the Clerk-Treasurer to deposit excess funds from all accounts in Time Open Agreements at Key Bank, Wells Fargo, First Niagara, and M & T Bank. Carried with all present voting aye. A motion was made by Trustee Hinkson, and seconded by Trustee McAvoy, to authorize the renewal of the Investment Policy as adopted by the Village Board on April 4, 1994, to include the following banks: Key Bank, Wells Fargo, First Niagara, and M & T Bank. Carried with all present voting aye. A motion was made by Trustee McAvoy, and seconded by Trustee Hinkson, to authorize mileage reimbursement at the rate of 56.5¢ per mile (current IRS recommendation is 56.5¢ per mile) for officers and employees who use their personal automobiles while performing their official duties on behalf of the Village. Carried with all present voting aye. A motion was made by Trustee McAvoy, and seconded by Trustee Blumrick, to authorize the Clerk-Treasurer to submit payment in advance of audit of claims for Public Utilities Services and postage prior to the monthly Board Meeting. Carried with all present voting aye. A motion was made by Trustee Hinkson, and seconded by Trustee McAvoy, to authorize the Mayor, Board of Trustees, and Department Heads to attend semi-annual meetings of the Northwestern Frontier Association of Village Officials, to be held in April and October of each year. Carried with all present voting aye. A motion was made by Trustee Blumrick, and seconded by Trustee McAvoy, to authorize the Clerk-Treasurer to attend the monthly meetings of the Niagara County Municipal Clerks Association and her deputies to attend meetings of same as deemed necessary by the Clerk-Treasurer, authorize the Police Chief to attend the quarterly Chiefs of Police meetings, and authorize the Village Coordinator to attend the monthly meetings of the Western New York Water Works Association and WNY Village Superintendents Association. Carried with all present voting aye. A motion was made by Trustee Hinkson, and seconded by Trustee Blumrick, to authorize Department Heads to approve necessary training at their discretion for members of their departments, including themselves, as it becomes available during the year. Should the cost be more than $1,000, Board Approval is necessary per the Village’s procurement policy. Carried with all present voting aye. A motion was made by Trustee McAvoy, and seconded by Trustee Hinkson, for the regularly scheduled Board of Trustees meetings to be the third Monday of each Month at 7:00 p.m., with the following exceptions: due to federal holidays, the January 2014 meeting and the February 2014 meeting will be held on the third Tuesday of the month. The 2014 Reorganization meeting will be held on Monday, April 7, 2014. Carried with all present voting aye. A motion was made by Trustee Blumrick, and seconded by Trustee Hinkson, to designate the Union Sun & Journal as the official newspaper. Carried with all present voting aye. A motion was made by Trustee McAvoy, and seconded by Trustee Hinkson, to approve the minutes of the March 18, 2013, meeting. Carried with all present voting aye. A motion was made by Trustee Blumrick, and seconded by Trustee McAvoy, to authorize payment of bills submitted on Abstract No. 11-12/13 in the amount of: General: $48,874.77; Water: $13,883.22; Sewer: $8,082.57; for a total of $70,840.56. Carried with all present voting aye. A motion was made by Trustee Hinkson, and seconded by Trustee Blumrick, to approve payrolls No. 22 and 23 for weeks ending March 30 and April 13, 2013. Carried with all present voting aye. The Treasurer’s report was submitted and accepted for March 2013. The Public Works report was submitted and accepted for March 2013. The Village and Town Police reports were submitted and accepted for March 2013, with Chief Swick reading the highlights. The fire report was submitted and accepted for March 2013, with Mayor Westcott reading the highlights. The Code Enforcement report was submitted and accepted for March 2013. At this time Mr. Belson asked permission to order signs that will be used to indicate that a building is unsafe. There are 3 designs, and each design means a different thing. Trustee McAvoy asked that the Fire Department be informed when a sign is placed at an address. A motion was made by Trustee McAvoy, and seconded by Trustee Hinkson, to authorize the purchase of 2 or 3 of each of the 24”x24” sign designs at a cost of $17.50 each from Ulrich Sign Company. Future purchases will be as needed. The signs are reusable. Carried with all present voting aye. The Village Historian’s annual report for 2012 was submitted and accepted. Correspondence was read: Received a notice from the NYS Public Service Commission regarding an Order Granting Petition in Part & Modifying Electric Safety Standards Received a listing from the Fire Department of the new officers & their contact information, as well as their financial report for 2012 Received a notice from the Niagara County Legislature regarding a resolution they passed about the Robert Moses Parkway Received a thank you note from the Middleport Senior Citizens regarding the installation of the blinds at the Scout House Mayor Westcott received an invitation from Independent Living regarding for their annual breakfast on May 3, 2013. If anyone is interested in attending, please let Clerk Schweigert know & she will get you registered. Mayor Westcott received an invitation from the Association of Erie County Governments to a dinner meeting with Niagara County Officials on May 23, 2013. He is unable to attend. If any members of the Board would like to attend, let Clerk Schweigert know so she may RSVP. At this time Patt Fagan and Julie Maedl from M. P. Fagan, Ltd., gave a presentation to the Board regarding the public relations campaign that is the result of a member’s item from Senator Maziarz. To date they have planned or are working on(among other things): setting up a website and have approached FMC about purchasing www.Middleport-NY.com to use as a link to the new website. setting up Facebook and Twitter accounts for the village. an idea in conjunction with the annual Tree Lighting ceremony called “Avenues of Trees.” Real trees will be purchased and staked on the Commons. Groups or families may “adopt” a tree to decorate. Will start with 12 trees to see the response. Hoping to get Santa to join in this year. putting up banners with a new logo & catch phrase “Life in a Village” and a porch. The DPW will need to put up the banners. an event to have local real estate agents come to hear about all that Middleport offers. signage along the canal for cyclists so they know what amenities are available in the Village. Everyone was very impressed with the campaign and thank Patt and Julie for all of their hard work on the campaign. Mayor Westcott closed the public hearing at this time, 8:05 p.m. Mayor Westcott passed around the prototype of the ID cards that we will be purchasing for all employees and officials. Photos will be taken by Chief Swick and submitted for the cards. Mayor Westcott and Trustees Blumrick and McAvoy will be attending NYCOM training on April 19, 2013. Mr. Seaman updated the Board on the proposed permit fee schedule submitted by Mr. Belson. The current law will be repealed so that in the future, any fee schedule changes may be done by resolution instead of changes to the local law. Mr. Seaman read the proposed fee local law to rescind the current charges and to allow for changes in the future. Trustee McAvoy introduced the local law as read by Mr. Seaman. A motion was made by Trustee Hinkson, and seconded by Trustee Blumrick, to hold a public hearing regarding the new local law on May 20, 2013, at 7:00 p.m. during the regularly scheduled May meeting. Carried with all present voting aye. Mr. Dodge advised the Board that he attended the Association Trade Show and learned that, although New York State has not put out a state bid price on the truck that we would like to purchase, there is a county that has done so and allows piggybacking per the recent changes to the New York State procurement policy. Mr. Seaman asked that Mr. Dodge get more information so that he can determine if the Village can order a truck through this bid. The next regular meeting of the Board of Trustees will be on Monday, May 20, 2013, at 7:00 p.m. A motion was made by Trustee Hinkson, and seconded by Trustee McAvoy, to adopt the 2013-2014 budget in the amount of $1,719,717.65. The true value tax rate will be $10.00 per thousand. This will result in a tax rate of $10.31 for Town of Royalton properties and $10.00 per thousand for Town of Hartland properties. Carried with all present voting aye. A motion was made by Trustee McAvoy, and seconded by Trustee Hinkson, to move into executive session for consultation with the attorney for the Village. Carried with all present voting aye. Mayor Westcott opened executive session at 8:17 p.m. A motion was made to Trustee Hinkson, and seconded by Trustee Blumrick, to return to general session. Carried with all present voting aye. Mayor Westcott reconvened general session at 8:44 p.m. A motion was made by Trustee Hinkson, and seconded by Trustee Blumrick, to authorize Wilson Environmental to do a delineation study for wetlands at the Village’s property on N. Hartland Street, for a maximum cost of $3,000. Carried with all present voting aye. A motion was made by Trustee McAvoy, and seconded by Trustee Hinkson, to adjourn.
