The annual reorganization meeting of the Board of Trustees was held on Monday, April 5, 2010, in the Village Hall. Mayor Maedl opened the meeting at 7:00 p.m. Also present were Deputy Mayor Conley, Trustee Bateman, Trustee Sarchia, Trustee Westcott, Coordinator Dodge, Police Chief Swick, Clerk-Treasurer Schweigert, and attorney Daniel E. Seaman. Clerk Schweigert led the Pledge of Allegiance. There were a few Village residents in attendance, as well. Mayor Maedl offered the following candidates for appointments: Deputy Mayor: Trustee Westcott Sewer & Sanitation Department: Trustee Conley Street Department: Trustee Bateman Water Department: Trustee Sarchia Board representatives to the Youth Recreation Board: Trustees Westcott and Sarchia Zoning Board of Appeals: Michael Conley to a 3-year term Youth Recreation, Executive Board: Tim Herriven & Jennifer DInieri to a 3-year term each Planning Board: Larry Lutz to a 5-year term Ethics Committee: Peggy Thomas, Liz Storch, and Trustee Bateman A motion was made by Trustee Westcott, and seconded by Trustee Conley, to approve all appointments. Carried. Mayor Maedl opened the Public Hearing regarding the 2010-2011 Budget at 7:05 p.m. Clerk Schweigert read the notice. Mike Cooley, 3 Francis Street, asked for some clarification on the new tax rate. He had misunderstood and thought it was being raised $1 per thousand, not 10 cents per thousand. Expenditure increases and cuts were explained as well. There being no other questions, the Public Hearing was closed at 7:17 p.m. Mayor Maedl advised the Board that Anna Wallace will be resigning as Village Historian. Mayor Maedl has asked Fred Fierch if he would be interested in being Historian. He is willing, if Deputy Historian Barb Albone continues to attend the county meetings. A motion was made by Trustee Bateman, and seconded by Trustee Conley, to appoint Fred Fierch to a one-year term as Village Historian. Carried. A motion was made by Trustee Conley, and seconded by Trustee Bateman to make the following reappointments to a one-year term: Thomas Arlington as Code & Zoning Enforcement Officer, Barbara Albone as Deputy Historian, Vicky Demmin as Deputy Village Clerk-Treasurer, and Barbara Noble as Deputy Clerk. Carried. A motion was made by Deputy Mayor Westcott, and seconded by Trustee Sarchia to designate HSBC, N.A., Middleport Office, as the Bank Depository. Carried. A motion was made by Trustee Bateman, and seconded by Trustee Conley, to authorize purchase of materials for street, water, and sewer departments at New York State or Niagara County bid prices. Carried. A motion was made by Trustee Conley, and seconded by Trustee Sarchia, to authorize Daniel E. Seaman to handle all legal matters on a per diem basis. Carried. A motion was made by Trustee Bateman, and seconded by Deputy Mayor Westcott, to authorize the the Clerk-Treasurer to deposit excess funds from all accounts in Time Open Agreements at HSBC, Wells Fargo, First Niagara, and M & T Bank. Carried. A motion was made by Deputy Mayor Westcott, and seconded by Trustee Sarchia, to authorize the renewal of the Investment Policy as adopted by the Village Board on April 4, 1994, to include the following banks: HSBC, Wells Fargo, First Niagara, and M & T Bank. Carried. A motion was made by Trustee Bateman, and seconded by Trustee Conley, to authorize mileage reimbursement at the rate of 50¢ per mile for officers and employees who use their personal automobiles while performing their official duties on behalf of the Village. Carried. A motion was made by Trustee Conley, and seconded by Trustee Sarchia, to authorize the Clerk-Treasurer to submit payment in advance of audit of claims for Public Utilities Services and postage prior to the monthly Board Meeting. Carried. A motion was made by Trustee Bateman, and seconded by Deputy Mayor Westcott, to authorize the Mayor, Board of Trustees, and Department Heads to attend semi-annual meetings of the Northwestern Frontier Association of Village Officials, to be held in April and October of each year. Carried. A motion was made by Trustee Bateman, and seconded by Trustee Sarchia, to authorize the Clerk-Treasurer to attend the monthly meetings of the Niagara County Municipal Clerks Association and her deputies to attend meetings of same as deemed necessary by the Clerk-Treasurer, authorize the Police Chief to attend the quarterly Chiefs of Police meetings, and authorize the Village Coordinator to attend the monthly meetings of the Western New York Water Works Association. Carried. A motion was made by Trustee Conley, and seconded by Deputy Mayor Westcott, to authorize Department Heads to approve necessary training at their discretion for members of their departments, including themselves, as it becomes available during the year. Should the cost be more than $1,000, Board approval is necessary per the Village’s procurement policy. Carried. A motion was made by Trustee Sarchia, and seconded by Deputy Mayor Westcott, to set the regularly scheduled meetings of the Board of Trustees as follows: meetings to be the third Monday of each Month at 7:00 p.m., with the following exceptions: due to federal holidays, the January and February 2011 meetings will be held on the Tuesday following the third Monday of the month (January 18 and February 22, 2011). The 2011 Reorganization meeting will be held on Monday, April 4, 2011. Carried. A motion as made by Deputy Mayor Conley, and seconded by Trustee Bateman, to designate the Union Sun & Journal as the official newspaper. Carried. A motion was made by Trustee Conley, and seconded by Deputy Mayor Westcott, to adopt the 2010-2011 budget of $1,732,283.09 and set the tax rate at $9.50 per thousand. Carried. A motion was made by Trustee Bateman, and seconded by Trustee Sarchia, to authorize Mayor Maedl to execute the Fire Protection Contract for the period April 1, 2010, to March 31, 2011, in the amount of $83,000. Carried. Coordinator Dodge advised the Board that the DEC is requiring flow monitoring again this year for the ongoing I&I investigation. TekSmith is willing to do this again for the same price as previous years, $6,000. A motion was made by Trustee Conley, and seconded by Trustee Bateman, authorizing TekSmith to be hired to do flow monitoring this spring at a cost not to exceed $6,000. Carried. Mayor Maedl advised she was contacted regarding the possibility of having a handicap parking spot placed in front of HSBC. We will contact NYSDOT to see if they will authorize this. Coordinator Dodge will get the dimensions of the spot for submission to the state with our request. Dawn Thompson and Julie Reigle, owners of the Basket Factory at 2 Watson Avenue, asked for some clarification from the Board regarding the upcoming public hearing on the noise ordinance amendments. Discussion ensued regarding this issue. The next meeting of the Northwestern Association of Village Officials will be held on Wednesday, April 21, 2010, with the Village of Holley as host. The next regularly scheduled meeting of the Board of Trustees will be held on Monday, April 19, 2010, at 7:00 p.m. A motion was made by Trustee Conley, and seconded by Deputy Mayor Westcott, to move into executive session for discussion with the attorney. Carried. Executive session was opened at 8:35 p.m. A motion was made by Trustee Conley, and seconded by Trustee Bateman, to return to general session. Carried. General session was reconvened at 8:45 p.m. Clerk Schweigert advised the Board that Independent Health will no longer provide health insurance coverage for the Medicare-eligible retirees as we have canceled our commercial policy. MVP, the company the rest of the employees are now insured by, has offered a comparable policy for the retirees. The Board reviewed the policy. A motion was made by Deputy Mayor, and seconded by Trustee Sarchia, to approve purchasing health care coverage for the Medicare-eligible retires from MVP. Carried. There being no further business, a motion was made by Trustee Bateman, and seconded by Trustee Conley, to adjourn. Carried. Meeting adjourned at 8:49 p.m. Respectfully submitted, Rebecca A.
