A regularly scheduled meeting of the Board of Trustees was held on Tuesday, February 17, 2009, in the Village Hall. Mayor Maedl opened the meeting at 7:00 p.m. Also present were Deputy Mayor Conley, Trustee Bateman, Trustee Sarchia, Trustee Westcott, Coordinator Dodge, Police Chief Swick, Clerk-Treasurer Schweigert. Deputy Mayor Conley led the Pledge of Allegiance. The owners of 96 Telegraph Road were present, as well. A motion was made by Trustee Bateman, and seconded by Deputy Mayor Conley, to approve the minutes of the January 20, 2009, meeting. Carried. A motion was made by Trustee Westcott , and seconded by Trustee Sarchia, to authorize payment of bills submitted on Abstract No. 9-X in the amount of General: $58,856.65; Water: $5,440.05; and Sewer: $11,337.54; for a Total of: $75,634.24. Carried. A motion was made Trustee Bateman, and seconded by Deputy Mayor Conley, to approve payrolls 17 and 18 for weeks ending January 24 and February 7, 2009. Carried. A motion was made by Deputy Mayor Conley, and seconded by Trustee Westcott, to authorize the Clerk-Treasurer to make the following budget transfers: TO FROM AMOUNT A1640.2 A1640.4 $ 125.00 A8010.4 A1990.4 25,100.00 TOTAL: $25,225.00 Carried. The Treasurer’s report was submitted and accepted for the month of January 2009. The Public Works report was submitted and accepted for the month of January 2009. The Village and Town Police reports were submitted and accepted for the month of January 2009, with Chief Swick reading the highlights. The fire report was submitted and accepted for the month of January 2009. The historian’s report was submitted and accepted for 2008. Water and sewer billing for February 1, 2009, were Water: $64,075.59; Sewer: $3,164.22; Total: $127,239.81. The following resolution was offered by Trustee Westcott, who moved its adoption, and seconded by Deputy Mayor Conley: RESOLVED, that the forthcoming General Village Election will be held on Wednesday, March 18, 2009, from 12:00 p.m. noon until 9:00 p.m. at the Village Hall, Middleport, New York. The following candidates were nominated for the office and term set forth before each name: CITIZEN’S PARTY Mayor: Two-year term Julia A. Maedl 33 Mechanic Street Middleport, New York PEOPLE’S PARTY Trustee: Two-year term Elizabeth Bateman 1 William Street Middleport, New York TAXPAYER PARTY Trustee: Two-year term Francis W. Sarchia, Jr. 26 Mill Street Middleport, New York RESOLVED, that this resolution shall be published in the official newspaper of the Village of Middleport by February 28, 2009. The vote on the above resolution was: Ayes: Deputy Mayor Conley, Trustee Bateman, Trustee Sarchia, Trustee Westcott, and Mayor Maedl. Nays: none. Absent: none. The resolution was duly adopted. Correspondence was read: Received a book on history in Niagara County. Under old business: Trustee Westcott gave an update on the dirt that needs to be moved from the parking lot on Main Street. Dan Dodge will get a copy of the tax map of the Mountain Road property and get it to the contractors. Jim Volkosh advised that Gregg Weber, from Natures’ Way, will contact Dan Dodge. The dirt will be moved after winter is done. DEC will issue final notice when the move is done. Nature’s Way submitted their plans to the DEC for approval. The Fire Department thanks the Board of Trustees for their cooperation and patience in this matter. The Fire Department is working on a grant to get this parking lot paved. Trustee Westcott asked if the property where the building was taken down (31 Main Street) will be backfilled. Person who was buying 29 Main didn’t want it filled. That deal has fallen through, so it probably will be done. Under new business: Clerk Schweigert advised the Board that she had spoken to a representative from AFLEC who is selling different insurances to employees. If employees are interested, may a date be set for them to meet with the representative. Okay to do this. Chief Swick asked for permission to purchase a radar unit to put in the new truck. A motion was made by Trustee Westcott, and seconded by Trustee Sarchia, granting permission to Chief Swick to purchase a radar unit at a cost of no more than $1,800. Carried. Linda Snell and Diane Strusienski addressed the Board about 96 Telegraph Road. They wrote letters to all of the Board members regarding the problems they have run into while trying to sell this property. The zoning has caused funding issues. HSBC says if it s commercial, have to have a commercial loan and can’t get a commercial loan for a house. Mayor Maedl advised that because the letters came in after the January Board meeting, the Board has not discussed this matter. As the Village’s attorney is not in attendance at this meeting, a response will not be given until after he’s been consulted. Ms. Snell and Ms. Strusienski would like the property rezoned. Discussed this issue. Mayor Maedl reiterated that the Board will need to consult with the Village’s attorney before any decision is made. The next regular Board meeting will be held on Monday, March 16, 2009, at 7:00 p.m. A motion was made by Trustee Bateman, and seconded by Trustee Sarchia, to move into executive session for the purpose of discussing proposed, pending or current litigation. Carried. Mayor Maedl opened executive session at 7:34 p.m. A motion was made by Deputy Mayor Conley, and seconded by Trustee Westcott, to move back into general session. Carried. Mayor Maedl reconvened general session at 7: 53 p.m. Mayor Maedl advised that it is time for the 2009-2010 budget to be pulled together. Mayor Maedl and the Department Heads met to discuss upcoming needs for their departments. Discussion ensued regarding this and when a budget meeting should be held. Clerk Schweigert will pull information together and email to Board prior to meeting. A motion was made by Trustee Westcott, and seconded by Trustee Bateman, to set a Board Meeting on Monday, March 2, 2009. At 5:30 p.m. to discuss the budget. Carried. There being no further business, a motion was made by Deputy Mayor Conley, and seconded by Trustee Sarchia to adjourn. Carried. Meeting adjourned at 8:17 p.m. Respectfully submitted, Rebecca A.
