A regularly scheduled meeting of the Board of Trustees was held on Tuesday, February 20, 2007, in the Village Hall. Mayor Maedl opened the meeting at 7:00 p.m. Also present were Deputy Mayor Conley, Trustee Bateman, Trustee Herriven, Trustee Kirkpatrick, Police Chief Swick, Village Coordinator Dodge, Clerk-Treasurer Schweigert, and Daniel E. Seaman, attorney. Trustee Kirkpatrick led the Pledge of Allegiance. A motion was made by Trustee Bateman, and seconded by Trustee Kirkpatrick, to approve the minutes from the January 16, 2007, meeting. Carried. A motion was made by Deputy Mayor Conley, and seconded by Trustee Herriven, to approve payment of bills submitted on Abstract 9-V in the amount of: General - $25,226.93; Water - $4,645.46; Sewer - $9,618.06; Total - $39,490.45. Carried. A motion was made by Trustee Bateman, and seconded by Trustee Kirkpatrick, to approve payrolls 18 and 19 for weeks ending January 27 and February 10, 2007. Carried. A motion was made by Trustee Herriven, and seconded by Trustee Kirkpatrick, authorizing the Clerk-Treasurer to make the following budget transfers: TO FROM AMOUNT A9060.8 A1990.4 $5,281.08 A1325.4 A9010.8 $2,000.00 A1490.11 A1490.1 $3619.30 A7310.4 A7145.1 $ 15.00 TOTAL: $10,915.38 Carried. Treasurer’s report submitted and accepted for the month of January 2007. The DPW report was submitted and accepted for the month of January 2007. The Village and Town Police reports were submitted and accepted for the month of January 2007. This Historian’s annual report for 2006 was submitted and accepted. Mayor Maedl advised the Board that she, Trustee Bateman, and Clerk Schweigert had attended the presentation of the book Niagara County released on February 16 about Veterans’ memorials around the county. Middleport’s Historian and Deputy Historian both worked on this book. The water and sewer billing for February 1, 2007, was Water: $58,892.91; Sewer: 48,132.73; Total: $117,025.64. The following resolution was offered by Deputy Mayor Conley, who moved its adoption, and seconded by Trustee Kirkpatrick: RESOLVED, that the forthcoming General Village Election will be held on Tuesday, March 20, 2007, from 12:00 p.m. noon until 9:00 p.m. at the Village Hall, Middleport, New York. The following candidates were nominated for the office and term set forth before each name: CITIZEN’S PARTY Mayor: Two-year term Julia A. Maedl 33 Mechanic Street Middleport, New York PEOPLE’S PARTY Trustee: Two-year term Elizabeth Bateman 1 William Street Middleport, New York PARTY OF ONE PARTY Trustee: Two-year term Timothy L. Hare 59 South Vernon Street Middleport, New York TAXPAYER PARTY Trustee: Two-year term Francis W. Sarchia, Jr. 26 Mill Street Middleport, New York RESOLVED, that this resolution shall be published in the official newspaper of the Village of Middleport by February 28, 2007. The vote on the above resolution was: Ayes: Deputy Mayor Conley, Trustee Bateman, Trustee Herriven, Trustee Kirkpatrick, and Mayor Maedl. Nays: none. Absent: none. The resolution was duly adopted. Correspondence was read. X Received a thank-you card from the family of Robert A. Knoop (Trustee Kirkpatrick and Swim Director Mullen’s father) for the donation made to the Middleport Free Library in his memory. X Received a request from the Olmsted Center for the Visually Impaired requesting that a “Blind Person Area” sign be installed on Kelly Avenue to benefit resident Elizabeth Allen of 29 Kelly Avenue. Coordinator Dodge verified with Mrs. Kelly that she did want this sign installed. Discussion ensued regarding installation. A motion was made by Trustee Bateman, and seconded by Trustee Kirkpatrick, authorizing the installation of a “Blind Person Area” sign near 29 Kelly Avenue as requested. Carried. Coordinator Dodge will handle ordering the sign and the installation. Coordinator Dodge mentioned that the owners of Stacks Convenience Store asked about installing a sign at the corner of South Vernon and Rte. 31 about his store. Discussion ensued regarding signs and sign laws. This issue may be formally addressed in the future. Attorney Seaman advised the Board that Chief Swick had approached the Town of Hartland about purchasing gasoline through them due to the change in ownership of Drumee’s. Clerk Schweigert explained about the need to get credit cards now, etc. The Village will save money if the Police Department purchases the majority of its gasoline through the Town of Hartland, as Hartland buys their gasoline on bid at a low price. It will not be cost effective to have the DPW purchase diesel gasoline from the Town due to the distance. A motion was made by Trustee Herriven, and seconded by Deputy Mayor Conley, authorizing Mayor Maedl to sign the contract with the Town of Hartland for the purchase of gasoline for the Police Department. Carried. Clerk Schweigert advised the Board that the fax machine in her office is ready to be replaced. It is 14 years old and doesn’t owe us anything. She got two bids: Panasonic Workio DPW-190 for $1795 Xerox WorkCentre M20i for $2295. A motion was made by Trustee Herriven, and seconded by Trustee Kirkpatrick, to purchase the Panasonic Workio DPW-190 for $1795. Carried. A motion was made by Trustee Bateman, and seconded by Trustee Kirkpatrick, to motion into Executive Session for the purpose of discussions regarding potential litigation and to consult with attorney. Carried. Mayor Maedl opened Executive Session at 7:25 p.m. A motion was made by Trustee Herriven, and seconded by Trustee Kirkpatrick, to return to General Session. Carried. Mayor Maedl reconvened General Session at 8:05 p.m. A motion was made by Trustee Herriven, and seconded by Deputy Mayor Conley, to authorize payment of unpaid bills in the amount of $1,806.60 from Wendel Duchscherer regarding the repairs to the digester lid from the cracking that began in Fall 2004. Carried. Clerk Schweigert passed out preliminary budget information for the General Fund only and went over what Mayor Maedl, Chief Swick, Coordinator Dodge, and she have already looked at. This will be discussed in detail at the March 3, 2007, meeting to be held at 8:30 a.m. Discussed sidewalk program. Mayor Maedl asked Coordinator Dodge to look into information about rubber sidewalks now being produced in Lockport. Is this something we can utilize?
