The annual reorganization meeting of the Board of Trustees was held on Monday, April 3, 2006, at 7:00 p.m. in the Village Hall. Trustee Thomas C. Conley and Trustee Theresa M. Kirkpatrick were sworn in by Clerk-Treasurer Schweigert. Following the swearing in, Mayor Maedl opened the meeting at 7:00 p.m. Also present were Clerk-Treasurer Schweigert, Police Chief Swick, and Daniel E. Seaman, attorney. Trustees Bateman and Herriven, and DPW Superintendent Mahar were absent. Mayor Maedl offered the following names for appointment to the various committees and departments: Deputy Mayor – Thomas Conley; Board Representative for Sewer and Sanitation Department – Tim Herriven; Board Representative for Street Department – Terry Kirkpatrick; Board Representative for Water Department – Liz Bateman; Board Representatives for the Youth Recreation Board – Tom Conley and Tim Herriven. Zoning Board of Appeals – Gene Dinse to a 3-year term Youth Recreation Executive Board – Dottie Barr, Audrey Smith, and Michele Smith to a 3-year term each. Planning Board – Harold Mufford to a 5-year term Tree Board – Liz Storch to a 5-year term Ethics Committee – Tom Conley, Liz Storch, and Karen Jones to a 1-year term A motion was made by Deputy Mayor Conley, and seconded by Trustee Kirkpatrick, to accept the above appointments. Carried, with Mayor Maedl voting to complete the quorum. Mayor Maedl opened the public hearing for the 2006-2007 budgets and Fire Protection at 7:05 p.m. Dispensed with reading the notice. A motion was made by Deputy Mayor Conley, and seconded by Trustee Kirkpatrick, to reappoint the following to a one-year term: Thomas Arlington – Code Enforcement Officer; Anna Wallace – Historian; Barb Albone – Deputy Historian; Vicky Demmin – Deputy Village Clerk-Treasurer; Barbara Noble – Deputy Clerk. Carried, with Mayor Maedl voting to make a quorum. Motion made by Deputy Mayor Conley, seconded by Trustee Kirkpatrick, to designate HSBC, N.A., and Middleport Office, as the bank depository. Corporate resolution was signed by all members present and is attached to the minutes. Carried, with Mayor Maedl voting to make a quorum. Motion by Trustee Kirkpatrick, seconded by Deputy Mayor Conley, authorizing all Department Heads to purchase materials for the street, water, and sewer departments at New York State or Niagara County bid prices. Carried, with Mayor Maedl voting to make a quorum. Motion by Deputy Mayor Conley, seconded by Trustee Kirkpatrick, authorizing Attorney Daniel E. Seaman to handle all legal matters as referred by the Mayor, Board of Trustees, and Clerk-Treasurer on a per diem basis. Carried, with Mayor Maedl voting to make a quorum. Motion by Deputy Mayor Conley, second by Trustee Kirkpatrick, authorizing the renewal of the Investment Policy as adopted by the Village Board on April 4, 1994, to include the following banks: Key Bank of Western New York, N.A., Bank of America, M & T Trust Company, and HSBC, N.A. Carried, with Mayor Maedl voting to make a quorum. Motion by Trustee Kirkpatrick, seconded by Deputy Mayor Conley, authorizing Clerk-Treasurer Rebecca A. Schweigert to deposit funds from all accounts in Time Open Agreements, Certificates of Deposit, or Money Market Agreements at HSBC, Key Bank of Western New York, N.A., Bank of America, and M&T. Carried, with Mayor Maedl voting to make a quorum. Motion by Trustee Kirkpatrick, seconded by Deputy Mayor Conley, authorizing mileage reimbursement at the rate of the present IRS rate per mile for officers and employees who use their personal automobiles while performing their official duties on behalf of the Village. Carried, with Mayor Maedl voting to make a quorum. Motion by Deputy Mayor Conley, seconded by Trustee Kirkpatrick, authorizing Clerk-Treasurer Rebecca A. Schweigert to submit payment in advance of audit of claims for Public Utilities Services, postage, and freight and express charges prior to the monthly Board Meeting. Carried, with Mayor Maedl voting to make a quorum. Motion by Trustee Kirkpatrick, seconded by Deputy Mayor Conley, authorizing the Mayor, Board of Trustees, and Department Head to attend triennial meetings of the Northwestern Frontier Association of Village Officials to be held in April, July, and October of each year. Carried, with Mayor Maedl voting to make a quorum. Motion by Deputy Mayor Conley, seconded by Trustee Kirkpatrick, authorizing the Clerk-Treasurer to attend the monthly meetings of the Niagara County Municipal Clerks Association and her deputies to attend meetings of same as deemed necessary by the Clerk-Treasurer, the Police Chief to attend the quarterly Chiefs of Police meetings, and Superintendent of Public Works to attend the monthly meetings of the WNY Water Works Association and the WNY Village Superintendents Association. Carried, with Mayor Maedl voting to make a quorum. A motion was made by Trustee Kirkpatrick, and seconded by Deputy Mayor Conley, authorizing Department Heads to approve necessary training at their discretion for members of their departments, including themselves, as it becomes available during the year. Should the cost be more than $1,000, Board Approval is necessary per the Village’s procurement policy. Carried, with Mayor Maedl voting to make a quorum. Motion by Deputy Mayor Conley, seconded by Trustee Kirkpatrick, to hold regularly scheduled meetings of the Board of Trustees at 7:00 p.m. on the third Monday of each month, with the following exceptions: due to federal holidays, the January and February 2007 meetings will be held on the third Tuesday of the month. The annual reorganization meeting will be held on Monday, April 2, 2007, at 7:00 p.m. Carried, with Mayor Maedl voting to make a quorum. Motion by Trustee Kirkpatrick, seconded by Deputy Mayor Conley, designating the Union Sun & Journal as the official newspaper for the Village of Middleport. Carried, with Mayor Maedl voting to make a quorum. At this time, Mayor Maedl closed the public hearing for the budget. Motion by Trustee Kirkpatrick, seconded by Deputy Mayor Conley, to adopt the 2006-2007 budget in the amount of $1,492,567.56. The tax rate was set at $8.40 per thousand. Carried, with Mayor Maedl voting to make a quorum. Motion by Deputy Mayor Conley, seconded by Trustee Kirkpatrick, authorizing Mayor Maedl to execute the Fire Protection Contract for the period of April 1, 2006, to March 31, 2007, in the amount of $78,000. Carried, with Mayor Maedl voting to make a quorum. The next regularly scheduled meeting of the Board of Trustees will be held on Monday, April 17, 2006, at 7:00 p.m. Clerk-Treasurer Schweigert advised the Board of the invitation to the annual appreciation luncheon given by the Sr. Citizens Group on Tuesday, April 25, 2006. Chief Swick advised the Board that Attorney Seaman has completed the contract for police services with the Town of Royalton, and it has been forwarded to the Town for approval. There being no further business, a motion was made by Trustee Kirkpatrick, and seconded by Deputy Mayor Conley, to adjourn. Carried. Meeting adjourned at 7:20 p.m. Respectfully submitted, Rebecca A.
